By clicking “I Agree”, “I Accept”, or by accessing, downloading, installing, or using the Platform or Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not access or use the Platform or Services. These Terms constitute a legally binding agreement between you and the Company.
1. Definitions
- “Application” / “App” / “Platform” means the mobile application and website operated by the Company for facilitating access to lending-related services.
- “Company” / “Lender” refers to Ayaan Finserve India Private Limited, a Non-Banking Financial Company (NBFC), having its registered office in Delhi.
- “Loan” means a credit facility that may be applied for through the Platform and, if approved, extended by the Lender subject to applicable eligibility criteria and terms.
- “Loan Agreement” means the legally binding agreement executed between the Lender and the borrower, in physical or electronic form.
- “Outstanding Amount” means the principal, interest, charges, or any other amounts payable under the Loan Agreement.
- “Services” means the digital facilitation of loan application, processing, servicing, and related support functions.
- “User” / “You” means any person accessing or using the Platform.
- “User Data” means information or documents submitted by you during registration or use of the Services.
- “Third-Party Platforms” means external platforms such as social media or verification service providers.
2. Scope of Services
The Platform enables Users to submit loan applications subject to eligibility criteria prescribed by the Lender and applicable laws. Submission of an application does not guarantee loan approval or disbursement.
The Company may collect, verify, and process User Data strictly for lawful purposes including identity verification, credit assessment, regulatory compliance, servicing, and customer support, in accordance with applicable laws and the Privacy Policy.
Loan approval, sanction, pricing, tenure, and disbursement remain at the sole discretion of the Lender and are subject to internal policies and regulatory requirements.
3. User Registration & Information
To access certain Services, you may be required to register and provide accurate, complete, and up-to-date information, including personal, contact, financial, and identification details as required under law.
You authorize the Company to:
- Verify submitted information through lawful sources
- Request credit information from credit information companies, where applicable
- Seek updated information periodically for compliance and servicing purposes
You remain responsible for the accuracy of all information provided.
4. Verification, Documentation & Disbursement
Upon submission of required information, the Company may undertake verification in accordance with regulatory norms. If found eligible, you may be required to complete additional documentation including mandates (ECS/NACH), consent forms, or other documents as prescribed by the Lender.
Loan disbursement, if approved, shall be made strictly in accordance with the executed Loan Agreement.
5. Repayment Obligations
You agree to repay the Loan strictly in accordance with the repayment schedule specified in the Loan Agreement. Failure to repay may result in applicable charges, reporting to credit bureaus, and lawful recovery actions as permitted under applicable laws.
6. Data Usage & Location Permissions
Certain features of the Platform may require access to device permissions, including location data, solely for purposes permitted by law such as fraud prevention, service delivery, or regulatory compliance.
Location access, where enabled, is used only while Services are active and in accordance with your device permissions and applicable data protection laws. Data collection ceases once it is no longer required for lawful purposes.
7. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. You must notify the Company immediately of any unauthorized use.
8. License to Use the App
The Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for lawful personal use, subject to these Terms.
The App is licensed, not sold. All intellectual property rights remain with the Company.
9. Prohibited Activities
You agree not to:
- Use the Platform for unlawful, fraudulent, or deceptive activities
- Upload malicious code or harmful content
- Interfere with the security or functioning of the Platform
- Impersonate another person or misrepresent identity
- Violate any applicable laws or regulations
10. Content Disclaimer
Content on the Platform is provided for general informational purposes only. The Company does not warrant completeness, accuracy, or uninterrupted availability of any content.
11. Intellectual Property
All content, trademarks, logos, software, and materials on the Platform are owned by or licensed to the Company. Unauthorized use is prohibited.
12. Third-Party Links & Advertisements
The Platform may contain links or advertisements from third parties. The Company does not control or endorse such third-party content and is not responsible for related transactions or interactions.
13. Ancillary Features
Any additional features such as chats, reviews, or blogs are provided on an “as available” basis. Opinions expressed are those of individual contributors and do not constitute professional advice.
14. Termination
The Company may suspend or terminate access to the Platform:
- For violation of these Terms
- For regulatory or legal reasons
- Upon discontinuation of Services
Termination does not relieve you of repayment or other legal obligations.
15. Disclaimer of Warranties
Services are provided on an “as is” and “as available” basis. The Company makes no express or implied warranties except as required by law.
16. Limitation of Liability
To the extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages arising from use or inability to use the Platform or Services.
17. Indemnity
You agree to indemnify the Company against losses arising from your violation of these Terms or applicable laws.
18. Force Majeure
The Company shall not be liable for failure to perform obligations due to events beyond reasonable control, including regulatory changes, system failures, or natural events.
19. Cancellation & Refund
- Pre-disbursement cancellation is permitted.
- Post-disbursement cancellation may be subject to repayment of principal and applicable charges.
- Excess payments, if any, shall be refunded after reconciliation within a reasonable timeframe.
20. Privacy
Personal data is collected and processed in accordance with the Company’s Privacy Policy available on the Platform.
21. Amendments
The Company may update these Terms periodically. Continued use of the Platform constitutes acceptance of updated Terms.
22. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Courts in Delhi shall have exclusive jurisdiction.
23. Miscellaneous
If any provision is held invalid, remaining provisions shall continue in effect. These Terms, together with the Loan Agreement and Privacy Policy, constitute the entire agreement.
